These Terms of Service ("Terms") govern your access to and use of the Curious Mail website, subscriber portal, and the monthly physical activity letters and educational materials sent to your designated shipping address (collectively, the "Service"). The Service is provided by Qualeady Pty Ltd ("Curious Mail," "we," "us," or "our").
We encourage all parents, guardians, and subscribers to read these Terms of Service carefully.
By creating an account, purchasing a subscription, or allowing your household to use our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you are not permitted to use the Curious Mail Service.
1. Description of the Service
Curious Mail provides a monthly mail subscription service designed to spark curiosity, imagination, and learning for children aged 4 to 8 years old. The Service includes:
Physical activity letters, interactive stories, puzzles, and educational materials mailed directly to your child at the provided shipping address each month.
Access to our online platform for account management and any supplementary digital content.
Important Adult Supervision Notice: Curious Mail adventures are designed for children aged 4–8. However, all physical activities, crafts, and experiments must be conducted under the direct supervision of an adult. You, as the parent or legal guardian, remain solely responsible for ensuring the activities are safe and appropriate for your child’s individual developmental level and that any household materials used alongside our letters are handled safely.
2. User Accounts & Eligibility
Registration: To join the club and receive Curious Mail, you must register for an account after purchase. You agree to provide accurate, complete, and current shipping and billing information at all times.
Eligibility: While our letters are written for children, the Service is intended strictly for purchase by adults. You must be at least 18 years of age and the parent or legal guardian of the child receiving the mail (or have the express permission of their parent/guardian) to open an account and purchase a subscription.
Account Security: You are responsible for safeguarding your login credentials and for any activities or actions under your password.
3. Fees, Payment, and Subscriptions
Subscriptions: Curious Mail is billed on a recurring subscription basis ("Subscription"). You will be billed in advance on a recurring, periodic basis (such as monthly or annually), depending on the plan you select.
Automatic Renewal & Cancellation: At the end of each billing cycle, your Subscription will automatically renew under the same conditions. You can cancel your Subscription at any stage through your online account management page. To avoid being billed for the next month's mailing, you must cancel before your next scheduled billing date.
Shipping & Delivery: We rely on postal services (such as Australia Post) to deliver our monthly letters. We are not responsible for postal delays, incorrect addresses provided by you, or items lost in transit, though our support team will always do our best to help locate a missing package.
Fee Changes: Curious Mail, in its sole discretion and at any time, may modify Subscription fees. We will provide you with reasonable prior notice of any fee changes to give you an opportunity to cancel your subscription before the change becomes effective.
Refunds: Except when required by law (including the Australian Consumer Law), paid subscription fees are non-refundable once a monthly cycle has been billed and processed.
4. User Content and Data Privacy
Your Content: If you upload, submit, or tag us in photos, reviews, or stories of your children interacting with Curious Mail ("User Content"), you retain full ownership of that content.
Our Limited License: By sharing User Content with us, you grant Curious Mail a worldwide, non-exclusive, royalty-free license to use, display, and reproduce that content for community and marketing purposes.
Protecting Young Explorers: In line with our dedication to safety, we will never publicly share your child's full name, location, or sensitive private details without your explicit, written consent.
Appropriate Use: You agree not to upload any content to our website or social media channels that is unlawful, offensive, discriminatory, or violates the privacy rights of others.
5. Intellectual Property
You agree that Curious Mail owns all intellectual property rights to the Service, including the original artwork, character designs, storylines, activity layouts, website assets, and logos. You are granted a limited, personal, non-commercial license to use the physical letters within your immediate household or classroom. You may not copy, redistribute, resell, or commercially exploit our materials.
6. Acceptable Use Policy
You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You agree not to:
Attempt to copy, replicate, or reverse-engineer our proprietary digital materials or website software.
Use our platforms or community forums to transmit any harassing, defamatory, or inappropriate material.
Use any automated system or "bots" to scrape data from our website.
7. Termination
By You: You may cancel your subscription at any time through your account settings. Physical shipments will cease at the end of your paid billing cycle.
By Us: We may suspend or terminate your account and subscription immediately, without prior notice, if you breach these Terms, fail to pay subscription fees, or act inappropriately toward our staff or community.
8. Disclaimer of Warranties
The Service and all physical letters are provided on an "as is" and "as available" basis. While we strive for educational enrichment and creative fun, we make no guarantees regarding specific learning outcomes. To the extent permitted by law, we disclaim all warranties, express or implied, regarding safety or fitness for a particular purpose if the materials are used without proper adult supervision.
9. Limitation of Liability
To the maximum extent permitted by applicable law (including the Australian Consumer Law), in no event shall Curious Mail, its directors, or employees be liable for any indirect, incidental, or consequential damages arising out of your use of the physical activity letters or service.
Our total aggregate liability for any claims arising out of these Terms or the use of our product is strictly limited to the greater of (a) $100 AUD or (b) the total amount of fees you paid to us in the 12 months preceding the event giving rise to the liability.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts located in Sydney, New South Wales.
11. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide a minimum of 30 days' notice prior to the new terms taking effect via email or a prominent notification on our website. By continuing your subscription after those revisions become effective, you agree to be bound by the updated terms.
